My Veterinarian, LLC is an Internet based Service (the “Service”) that is provided for educational purposes only. By checking “I Agree” during account registration and/or payment page or by using this site in any way, you are agreeing to comply and be bound by this Agreement (the “Terms of Use”), and the Privacy Policy. By checking “I Agree” and/or using this Service, you expressly acknowledge and understand that there are risks and limitations associated with this type of veterinary web-based consulting Service and agree that My Veterinarian, LLC is not a substitute for regular veterinary care for your dogs and or cats, that a licensed veterinarian provides through regular, routine, in-person office visits.

BY USING THIS SERVICE, YOU AGREE THAT THE SERVICE IS NOT A SUBSTITUTE FOR AN EMERGENCY CONSULTATION FACILITY AND THAT My Veterinarian, LLC CANNOT PROVIDE ADVICE OR CONSULTATION REGARDING IMMEDIATE EMERGENCY ATTENTION. IF YOUR PET IS IN IMMEDIATE MEDICAL NEED OR HAS BEEN IN AN ACCIDENT, YOU AGREE TO CONTACT YOUR REGULAR VETERINARIAN, LOCAL ANIMAL HOSPITAL, AND/OR EMERGENCY HOSPITAL IMMEDIATELY. YOU AGREE THAT BY USING THE SITE AND THE SERVICE YOU ARE AT LEAST 18 YEARS OF AGE.

My Veterinarian, LLC, the owners of the Site, and professionals who offer services through the Site accept no responsibility for any medical, legal, or financial events or outcomes related to the Service attained through the Site, which is being provided on an as is basis. My Veterinarian, LLC acts as a venue for entertainment purposes. In the Terms of Service, “User,” “your” and “you” refer to the individual or entity that creates a myvetnow.com account as a Customer and/or Expert. “Customer” refers to the person who asks a question on the Site. The terms “Consultant”, “Advisor”, “Expert”, and “Poster” may be used throughout our Site to identify an individual who claims to have certain knowledge, background, or experience that may be useful in responding to questions posed by Users. The service is not intended to:

  • Treat a medical emergency or medical condition.
  • Advise or resolve legal, medical, or financial issues outside the scope of what has been agreed or provided.
  • Establish a Veterinarian-Client-Patient Relationship

For any medical emergency immediately contact an emergency hospital in your country. Information or advice provided on the Site by professionals should be used merely as a guide rather than a definitive recommendation to adopt any specific action or treatment. Nothing transmitted to or from this Site constitutes the establishment of a Veterinarian-Client-Patient Relationship between you, your pet, and any professional. The site is not intended to prescribe medicine or diagnose a medical condition.

My Veterinarian, LLC does not review every posts on the Site (excluding, however, myvetnow.com’s right to access accounts to ensure that the system is working and/or in the case of any technical dysfunction) and the views expressed therein are those of the posters and do not necessarily reflect those of myvetnow.com, its owners, managers, contractors, directors, employees, agents, partners, advertisers, or affiliates. myvetnow.com assumes no responsibility for the posts or the information contained therein, nor does it make any claims, promises or guarantees about the accuracy, suitability or completeness of any of the information on the Site or in the posts. All advice and/or information obtained directly or indirectly from the Site are provided at your own risk.

The My Veterinarian, LLC Service is a passive conduit allowing pet owners the opportunity to contact “advisors”, “consultants”, and “experts” that may or may not have knowledge or expertise in a specific area. We do not employ the “advisors”, “consultants”, and “experts” and we do not, and cannot, ensure that they have any particular knowledge in a specific area. While the “advisors”, “consultants”, and “experts” have been verified to be licensed veterinarians, there is no Veterinarian-Client-Patient Relationship between a user and the “advisor”, “consultant”, or “expert”. By offering assistance through the Site, the “advisors”, “consultants”, and “experts” are not practicing veterinary medicine. You are aware that following the advice of our “advisors”, “consultants”, and “experts” and any other information on the site could harm your pet.

The information on this Website (including but not limited to texts, emails, phone support) is provided for general informational purposes only and SHOULD NOT be relied upon as a substitute for sound professional veterinary medical advice, evaluation, or care from your veterinarian. Nothing on the Site should be used for treating or diagnosing a pet’s medical or health condition or for replacing any relationship with your veterinarian. If you access the Site from outside the United States of America, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. Provisions relating to the liability of My Veterinarian, LLC and its licensors, user submissions, Indemnity, Jurisdiction, and Complete Agreement, survive the expiration or termination of these Terms and Use for any reason whatsoever.

All rights reserved”. The Content is protected by copyright under both United States and foreign laws. The Title to the Content remains with myvetnow.com. Content and features are subject to change or termination without notice in the editorial discretion of My Veterinarian, LLC. You understand that all payments made to My Veterinarian, LLC are in the form of United States of America dollars (USD).

Liability of myvetnow.com, LLC and Professional Advisors/Consultants/Experts

The use of the myvetnow.com Site and the Content is at your own risk. When transmitting information to its users, My Veterinarian, LLC will be using mediums that may be beyond the control and jurisdiction of My Veterinarian, LLC. My Veterinarian, LLC assumes no liability for or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with the use of myvetnow.com Site.

The My Veterinarian, LLC Site and the Content are provided on an “as is” basis. My Veterinarian, LLC, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES’ RIGHTS, AND FITNESS FOR PARTICULAR PURPOSE. Without limiting the foregoing, My Veterinarian, LLC and the veterinary professionals that generate Content make no representations or warranties about the accuracy, reliability, completeness, currentness, or timeliness of the Content, software, text, graphics, links, or communications provided on or through the use of the My Veterinarian, LLC Site. Without limiting the foregoing, My Veterinarian, LLC and the veterinary professionals that generate Content make no representations or warranties about the satisfaction of any government regulations requiring disclosure of information on prescription drug products, off-label medications, or the approval or compliance of any software tools with regard to the Content contained on the My Veterinarian, LLC Site.

In no event shall My Veterinarian, LLC, its professional advisors, or any third parties mentioned on the myvetnow.com Site be liable for any damages (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) resulting from the use of or inability to use the My Veterinarian, LLC Site or the Content, whether based on warranty, contract, tort, or any other legal theory, and whether or not My Veterinarian, LLC, its licensors, contractors, or suppliers, or any third parties mentioned on the My Veterinarian, LLC Site are advised of the possibility of such damages. My Veterinarian, LLC, its licensors, its suppliers, its contractors, or any third parties mentioned on the My Veterinarian, LLC Site are not liable for any personal injury, including death, caused by your use or misuse of the Site, Content, or public areas. Any claims arising in connection with your use of the Site, any Content, or the public areas must be brought within one (1) year of the date of the event giving rise to such action occurred. User Submissions (Image, Text, Medical Documents)

You agree to only post or upload Image, text, and medical documents (“Media”) that you have created or taken yourself or have the explicit approval to transmit and license and which do not violate trademark, copyright, privacy, or any other rights of any other person. Uploading media, such as but not limited to images or video of other people without their permission is strictly prohibited.

By uploading any media like a photo (a) you grant to My Veterinarian, LLC a perpetual, non-exclusive, worldwide, royalty-free license to use, copy, print, display, reproduce, modify, publish, post, transmit and distribute the media and any material included in the media; and (b) you certify that any person pictured in the submitted media (or, if a minor, his/her parent/legal guardian) authorizes My Veterinarian, LLC to use, copy, print, display, reproduce, modify, publish, post, transmit and distribute the media and any material included in such media; and (c) you agree to indemnify My Veterinarian, LLC and its affiliates, directors, officers and employees and hold them harmless from any and all claims and expenses, including attorneys’ fees, arising from the media and/or your failure to comply with these the terms described in this document. My Veterinarian, LLC reserves the right to review all media prior to submission to the site and to remove any media for any reason, at any time, without prior notice, at our sole discretion. My Veterinarian, LLC will maintain a perpetual, non-exclusive, worldwide, royalty-free license to use, copy, print, display, reproduce, modify, publish, post, transmit and distribute Content created by its veterinary professionals in response to any question asked during the use of the Service.

Notwithstanding the foregoing, My Veterinarian, LLC reserves the right, but are not obligated, to remove any content that we believe violates any of or Terms of Use, including, without limitation, any objectionable or personally identifiable information.

Geographic Specifics

My Veterinarian, LLC is based in Scottsdale Arizona, in the United States of America. My Veterinarian, LLC makes no claims that myvetnow.com, or any linked Site within the myvetnow.com and the Content are appropriate or may be downloaded outside of the United States. Access to the Content may not be legal by certain persons or in certain countries. If you access the myvetnow.com or Internet links from myvetnow.com from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. If you are a California resident, you waive California Civil Code §1542, which provides: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.”

Jurisdiction

You expressly agree that exclusive jurisdiction for any dispute with myvetnow.com, or in any way relating to your use of the myvetnow.com Site, resides in the courts of the State of Pennsylvania and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of Pennsylvania in connection with any such dispute including any claim involving My Veterinarian, LLC or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers, and content providers.

These Terms and Conditions are governed by the internal substantive laws of the State of Pennsylvania, without respect to its conflict of laws principles. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

Changes in Terms of Service

It is your responsibility to review these Terms of Use periodically. If at any time you find these Terms of Use unacceptable or if you do not agree to these Terms of Use, please do not use this Site.
